Terms of Service

1. Acceptance

Welcome to DogearAI (the "Service"), a portable memory layer for AI tools operated from dogearai.com. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. The Service

DogearAI lets you store notes once and make them available as shared context to the AI tools you use. You submit text via the API, an MCP client, or the dashboard; the Service classifies it into a memory space, compresses it to its essence, and retains the original. You can later inject this context into AI tools or export it at any time.

3. Account

You may use the Service through an anonymous account or by binding an email address. You are responsible for all activity under your account and for keeping your access tokens and credentials secure. Notify us immediately of any unauthorized use. Tokens are shown once at creation — store them safely.

4. Plans & Billing

• The Service is free during open beta, subject to fair-use limits on the number of memories and spaces.
• Pro is a recurring subscription billed at US$12 per month. It renews automatically each month until you cancel.
• You may cancel at any time; cancellation stops future renewals and your Pro access continues until the end of the current billing period.
• Payments are processed by Dodo Payments as the Merchant of Record. Refunds are governed by our Refund Policy.

5. Acceptable Use

You may not:

• Store, transmit, or process content that is illegal, infringing, or violates the rights of others;
• Use the Service to harass, defraud, or harm others, or to store others' personal data without a lawful basis;
• Attempt to access another user's data, breach security, or circumvent rate limits and budget gates;
• Resell, sublicense, or build a competing service on top of the Service without our written consent.

Accounts violating this policy may be suspended or terminated.

6. Your Content & Ownership

You retain all rights to the memories and content you submit. You grant us a limited license to store, process, and transmit your content solely to operate the Service — including sending text to a third-party model API for classification and summarization.

We do not use your content to train AI models. Your memories are stored in plain text in your account, and you can export or delete them at any time.

7. Third-Party Services

The Service relies on third parties including, but not limited to, Supabase (database and authentication), Dodo Payments (payments), an OpenAI-compatible model provider such as DeepSeek / DMX API (memory extraction), and Vercel (hosting). Your use is also subject to their respective terms.

8. Changes & Termination

We may modify, suspend, or discontinue any part of the Service at any time. For material changes we will notify you by email or in-app notice. We may terminate your access if you violate these Terms. You may stop using the Service and delete your account at any time.

9. Disclaimer

The Service is provided "as is" and, during beta, without any service-level guarantee. We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or the accuracy of AI-generated summaries. You are responsible for reviewing memory content before relying on it.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages. In no event shall our aggregate liability exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the People's Republic of China. Disputes shall first be resolved through good-faith negotiation; failing that, courts at our place of business shall have jurisdiction.
